The purpose of this Policy is to demonstrate Proship Brasil's commitment to the privacy and protection of your Personal Data, in addition to establishing rules on the Processing of your Personal Data within the scope of the services and functionalities of our website, in accordance with Law No. 13,709/2018 and related legislation, with transparency and clarity for data holders.

Proship Brasil uses its best efforts to provide adequate protection measures in all its operations and to implement the most consistent, effective and rigorous policies and procedures. Recognizing the importance of your privacy, we have developed this Policy to inform you about the conditions under which we process and protect your Personal Data. This Policy also describes your rights and how you, as a data subject, can contact us to exercise them.

By accepting the content of this Policy, you are aware that Proship Brasil is the Controller of your Personal Data and declare and agree that we can process your Personal Data in accordance with the terms established here, as well as expressing awareness that this Policy may be modified, at any time, with all updates published on this page. Therefore, we recommend that you carefully read our entire Policy. If you do not comply with the provisions, we ask that you immediately stop accessing and using the website.

DEFINITIONS

For the purposes of this Policy, the following definitions must be considered, when referred to in capital or lower case letters, plural or singular, with or without bold, for correct understanding:

"Personal Data": Means any information relating to an identified or identifiable natural person. This means that data is considered personal when it allows the direct or indirect identification of the natural person, such as: name, surname, date of birth, telephone number, email, etc.

"LGPD": General Personal Data Protection Law (Law No. 13,709, of August 14, 2018).

"Processing": Any operation carried out with Personal Data, such as those relating to collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transparency, dissemination or extraction.

"Legal Bases": Legal bases are the legal hypotheses provided for in the LGPD that authorize Proship Brasil to process Personal Data.

"we or our": Proship Brasil, hereinafter referred to as Proship Brasil.

"You": Any Individual or representative of a Legal Entity, as a visitor to Proship Brasil;

"Controller": Natural or legal person, governed by public or private law, who is responsible for decisions regarding the Processing of Personal Data.

HOW WE STORE YOUR PERSONAL DATA AND RECORD ACTIVITIES

The Personal Data collected and activity records will be stored in a secure and controlled environment for a minimum period established by law in accordance with Art. 9, Item II of the General Personal Data Protection Law, and other legal diplomas that may be applicable.

Longer storage periods. For the purposes of auditing, security, fraud control, credit protection and preservation of rights, we may retain the record history of your Data for a longer period of time, in cases established by law or regulatory standard or to preserve rights.

The collected data will be stored on our servers, as well as in an environment where resources or servers are used in the cloud (cloud computing).

YOUR RIGHTS AND HOW TO EXERCISE THEM

Proship Brasil respects the rights you have as a holder of Personal Data and we enable their exercise in accordance with applicable legislation. Below you will find a table that summarizes the rights provided for in article 18 of Law No. 13,709/2018:

Limitation, opposition and deletion of data. Through the Communication Channel, which we will make available on our website, you can request all the rights set out in the table above.

It is important to clarify that if you request the deletion of your Personal Data or withdraw your consent for purposes that are fundamental to the regular functioning of the site and its services, such environments and services may become unavailable to you.

Furthermore, we may store this personal data in our database, in accordance with article 16 of the General Personal Data Protection Law, for the following purposes: (i) compliance with legal or regulatory obligations, (ii) study by a research body, and (iii) transfer to a third party (respecting the data processing requirements set out in the same Law). In all cases, whenever possible, your Personal Data will be anonymized. Even after the processing of personal data has ended, or if you have requested its deletion, we may retain this personal data in our database, in accordance with article 16 of the General Personal Data Protection Law, for the following purposes: (i) compliance with legal or regulatory obligations, (ii) study by a research body, and (iii) transfer to a third party (respecting the data processing requirements set out in the same Law). In all cases, as long as possible, your Personal Data will be anonymized.

After the maintenance period and legal necessity have ended, Personal Data will be deleted using secure disposal methods, or used in an anonymized form for statistical purposes.

Changing the content and updating. You acknowledge our right to change the content of this Policy at any time, according to the purpose or need, such as for adequacy and legal compliance with a provision of law or standard that has equivalent legal force, and it is up to You to check it whenever you access the website or use our services.

If you are not domiciled in Brazil, you agree that because the services offered by us apply only to the national territory, discussions regarding this Policy will be subject to Brazilian legislation, and, if there is a dispute to be resolved, the action must be filed in the São Paulo District Court, State of São Paulo.
